Abstract

This research aims to resolve the dispute between the early scholars regarding the independence of the Sunnah in establishing rulings in the first place, or whether it is nothing more than a mere
detail and clarification of what was stated in the Qur’an. All of this is in order to test the statement of some contemporary trends that they are based on the opinion of some of the early scholars. They have established a rule that stipulates that every hadith for which they do not find a basis in the Qur’an is a rejected hadith... Accordingly, the problem of the research is summed up in the following question: How sound is the claim that the Sunnah is not independent of legislation, and what is the legitimacy of relying on it to reject hadiths? The method used in this research is the descriptive-comparative method and then the analytical-dialectical method. In this research, we will focus on the opinions of the ancients regarding this issue without addressing the point of view of some contemporaries because their claim as they say is based on the statements of some of the predecessors, which means that the value of what they wrote and the possibility of evaluating it depends first and foremost on studying and testing the basis on which they relied.
